Privacy Policy

The protection of your personal data is of particular importance to me – especially because very sensitive information is often shared in the course of psychological counselling. Below, I inform you about which personal data is processed when you use this website and in the course of counselling.

1. Controller

The controller responsible for data processing on this website is:

Tatiana Iamnitskaia
Psychological Counselling
Contact: contact@empathy-to-life.net

Further details can be found in the Legal Notice.

2. Hosting and server log files

This website is hosted by STRATO AG. The servers are located within the European Union. STRATO processes personal data under a data processing agreement in accordance with Article 28 GDPR. A corresponding data processing agreement has been concluded.

When you access the website, the hosting provider automatically collects technical information in so-called server log files transmitted by your browser. This includes:

This data is technically required to provide the website securely and without errors and to ensure the stability and security of server operation (Article 6(1)(f) GDPR). This data is not combined with other data sources.

3. Contact by e-mail

If you contact me by e-mail, the data you provide (e.g. your name, e-mail address and the content of your message) will be processed in order to respond to your enquiry and clarify any follow-up questions.

The legal bases for this are:

This website deliberately does not use a contact form or any automated form processing. Communication takes place exclusively by direct e-mail.

4. Special categories of personal data in counselling

In the course of psychological counselling, information about your mental and, where relevant, physical health, as well as personal life circumstances, may be discussed. This constitutes special categories of personal data within the meaning of Article 9 GDPR.

This data is processed exclusively on the basis of your explicit consent (Article 9(2)(a) GDPR), which you give before counselling begins. Details can be found in the Counselling Contract (PDF).

You can withdraw your consent at any time with effect for the future. Withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal. Unless statutory retention obligations apply, the relevant personal data will be deleted.

All counselling content is treated confidentially and is generally not disclosed to third parties. Exceptions apply if I have your consent, if I am legally obliged to disclose it, or if disclosure is necessary due to an acute risk to the life of the person seeking counselling or a third party. Further details can be found under Confidentiality.

Online counselling

For video counselling, privacy-friendly video conferencing services (e.g. Senfcall or comparable services) are used wherever possible. Platforms are selected with a focus on a high standard of data protection. Senfcall, for example, operates its servers exclusively within Germany and is subject to German and European data protection regulations.

On request, counselling can also be conducted via Zoom or Microsoft Teams. In this case, the personal data required to conduct the online counselling is processed. Depending on the provider, the transfer of data to third countries, in particular the USA, cannot be ruled out.

The Privacy Policy of the respective service used applies in addition.

Further information can be found in the Counselling Contract (PDF).

5. Address for service (Postflex)

A virtual business address provided by Postflex® is used as the address for service in the Legal Notice. Incoming postal mail sent to this address is opened, digitised and then forwarded to me electronically by Postflex.

Postflex processes personal data on the basis of a data processing agreement in accordance with Article 28 GDPR, which I have concluded with the provider. Further information on data processing by Postflex can be found in the provider's Privacy Policy.

A separate postal address is also available for confidential documents. Further information can be found in the Legal Notice.

6. Payment processing (PayPal)

If you choose to pay via PayPal, the personal data required for payment processing will be transmitted to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. Processing takes place for the purpose of payment processing on the basis of Article 6(1)(b) GDPR.

Within the scope of payment processing, the transfer of personal data to companies of the PayPal group, including in third countries, in particular the USA, cannot be ruled out. PayPal uses appropriate safeguards for this in accordance with Articles 44 et seq. GDPR.

Further information on data processing by PayPal can be found in PayPal's Privacy Policy.

7. Cookies and tracking

My website uses only technically necessary session cookies. These serve to provide the basic functions of the website and to ensure its secure and proper operation. The cookies are stored only for the duration of your visit to the website and are automatically deleted when you close your browser. Without these cookies, the website cannot function correctly.

Processing takes place on the basis of Article 6(1)(f) GDPR, as there is a legitimate interest in the technically error-free and secure provision of the website. Insofar as information is stored on or accessed from your device, this is governed by Section 25(2) No. 2 TDDDG (German Telecommunications-Digital-Services-Data-Protection Act).

This website does not use cookies for analysis or marketing purposes and does not employ any tracking or analytics tools (e.g. Google Analytics). Likewise, no external fonts, map services, social media plug-ins or comparable services that could transmit personal data to third parties are embedded. Personal data is not transmitted to third parties for analysis or advertising purposes. No user profiles are created.

8. SSL/TLS encryption

This website uses SSL/TLS encryption to protect the transmission of personal and other confidential data from unauthorised access. You can recognise an encrypted connection by the "https://" prefix and the lock symbol in your browser's address bar.

9. Storage period

Personal data is stored only for as long as necessary for the respective purpose or as required by statutory retention obligations (e.g. tax or commercial law retention periods).

Content collected or discussed in the course of counselling is retained only for as long as necessary for the provision and follow-up of counselling, unless longer statutory retention obligations apply.

Once the respective purpose of processing no longer applies, personal data is deleted unless statutory retention obligations require otherwise.

10. Your rights

You have the following rights regarding your personal data:

To exercise these rights, an informal e-mail to contact@empathy-to-life.net is sufficient.

11. Right to lodge a complaint with a supervisory authority
